Digital Millennium Copyright Act Notice and Takedown Procedure


Files-Save intends to fully comply with the Digital Millennium Copyright Act ("DMCA"), including the notice and "take down" provisions, and to benefit from the safe harbors immunizing Files-Save from liability to the fullest extent of the law. Files-Save reserves the right to terminate the account of any Member who infringes upon the copyright rights of others upon receipt of proper notification by the copyright owner or the copyright owner's legal agent.


We take abuse of our service very seriously. If you wish to report a copyright infringement, we need you to send us a proper notification. A proper notification MUST have at least the following information, or it may be IGNORED!



1. Identify yourself as either:
     a: The owner of a copyrighted work(s), or
     b: A person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. State your contact information, including your TRUE NAME, street address, telephone number, and email address.

3. Identify the copyrighted work that you believe is being infringed, or if a large number of works are appearing at a single website, a representative list of the works.

4. Identify the material that you claim is infringing your copyrighted work, to which you are requesting that Files-Save disable access over the World Wide Web.

5. Identify the material by its URL(s).

6. State that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agents, or the law.

7. State that the information in the notice is accurate, under penalty of perjury.

Once it is determined that a file which has been uploaded is in violation of a copyright we will remove the file immediately.


To send a counter-claim for material that has been removed, you must contact Files-Save's designated agent by using the form below and selecting "Submit a Counter Claim" The following information is required to submit a counter-claim and it may be ignored if the information is incomplete or lacking what is required:

  • Proper identification of the material that has been removed, and the web URL where the material appeared before it was removed.

  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed as a result of mistake, or as a result of misidentification of the material to be removed.

  • Your name, address, telephone number, and, if available, e-mail address.

  • A statement that you consent to the jurisdiction of the Federal District Court in the judicial district in the United States in which your address is located, or if your address is outside the United States, in Middle District of Tennessee, and that you will accept service of process from the person who provided notification of the alleged infringement or from an agent of such person.

  • Your physical or electronic signature.

This information must be submitted within ten business days from the time you were given notice that the material had removed or access to it was disabled. If your counter-claim is not received within the allotted time, the material will be permanently removed.
